A pensioner accused of driving a mobility scooter while drunk and falling into the River Dee will face no further court action.
Emergency services were called to the Robert Gordon University in Aberdeen on Garthdee Road following reports that a man was in distress following a collision.
Eleven firefighters, five police officers and paramedics were sent to the scene at around 6.20pm on March 27.
John Nicol, 65, was charged with culpable and reckless conduct and was due to go on trial at Aberdeen Sheriff Court yesterday.
It was claimed he had collided with a tree and needed to be rescued by members of the public and the emergency services.
Nicol, of Two Mile Cross in Aberdeen, did not appear in court yesterday and last night a Crown spokesman confirmed the case would now be closed.
He said: “It is the duty of the Crown to keep cases under review and after full and careful consideration of the facts and circumstances of the case the procurator fiscal decided that there should be no further proceedings taken at this time.
“The Crown reserves the right to re-raise proceedings in future.”
During a preliminary hearing into the trial the court heard Nicol had encountered numerous health problems and found it extremely difficult to leave his house.
