A court has been told that trading standards officers made mistakes in their investigation of a north-east property firm which allegedly mis-sold homes.
Dandara Limited is accused of giving false information to Ronald and Sally Buxton and Mandy and Peter McLeod before they bought apartments in the developer’s Stoneywood Estate in Aberdeen.
It is also alleged the McLeods were misled by a brochure, which it is claimed did not show a pillar which would obscure their view from a window.
The couples were sold their properties in May and April 2013.
The company is also accused of falsely advertising room sizes at the development between May 1 and 31, 2013.
It denies all the allegations.
Graham Shand, a senior enforcement officer at Aberdeen City Council Trading Standards, was called to give evidence yesterday.
Fiscal Depute, Sophie Hanlon, asked him if he was confident the measurements he took were accurate.
He replied: “Yes, I am confident.”
However, he was later questioned by defence counsel Murdo MacLeod QC and asked to look at his work.
Mr MacLeod said: “Do you accept you have managed to measure all three rooms differently in different flats.”
Mr Shand agreed that he had.
Mr MacLeod later argued the crown had produced no evidence Dandara had misled anyone and produced a no case to answer submission.
The motion was dismissed by Sheriff Morag McLaughlin.
