A man has been jailed for robbing a store as a member of staff was having a seizure – while his partner in crime was spared prison.
Mark Mackenzie and Gordon Milne entered the Keystore on Summerfield Terrace on December 20 last year when they noticed an employee had become unwell.
The pair took advantage of the situation and made off with cigarettes and alcohol.
They confessed to the offence at an earlier date and returned to Aberdeen Sheriff Court yesterday to be sentenced.
Representing Mackenzie, of Wernham House in Aberdeen, defence agent Lynn Bentley said he had not gone into the shop with the intention of stealing but suffered from an alcohol problem.
And representing Milne, of Ritchie Place in Aberdeen, Michael Burnett asked for his client to be placed on a deferred sentence for good behaviour.
Imposing a sentence, Sheriff Robert Mcdonald said to Mackenzie, aged 45: “In your case I really have very little alternative to a custodial sentence.
“It is a despicable thing to do to take advantage of someone who is clearly not very well.”
He jailed him for two months.
However he said to Milne, aged 59: “I am going to defer sentence for good behaviour for six months.”
“You should not think you are getting off.”
