Two bouncers who were cleared of murdering a father outside a bar were spared jail sentences for assault today.
As one of the pair was sentenced at the High Court in Edinburgh to a community payback order calls rang out from the public benches of “no justice” and “it’s criminal”.
Add Media, Keil Hauley and Jonas Marcius had denied murdering Craig Grant outside the Tonik bar in Aberdeen along with a third co-accused Adrian Morley.
Morley (33) of Ashvale Place, Aberdeen, was cleared of the charge during an earlier trial.
The Crown accepted a plea from Hauley (33) of Printfield Walk, in Aberdeen, to a charge of attempting to assault Mr Grant (26) by repeatedly trying to punch him on the head.
Marcius (23) of Merkland Road, Aberdeen, was convicted of assaulting him by seizing him by the neck and forcing him to the ground, placing him in a neck hold or choke hold and compressing his neck, holding him down on the ground and restricting his breathing.
An allegation that the university student had asphyxiated him and murdered him was rejected by jurors at his trial.
Marcius, a first offender from Lithuania, was ordered to carry out 250 hours unpaid work under a community payback order.
A judge told him he had used a type of hold that was regarded as dangerous and never to be used.
But Lady Wolffe said that with some hesitation she had come to the view that a term of imprisonment would not be appropriate or proportionate. The judge also ordered that Hauley should perform 90 hours unpaid work under a community payback order.
