Paramedics treated both men, but Mr McKenzie died from his injuries.
Police today confirmed a 37-year-old man will appear at Elgin Sheriff Court in connection with the accident.
Mr McKenzie is survived by his children, Max and Hayleigh, and his parents Neil and Kate.
Rothes councillor Pearl Paul has led tributes to the dad, who was known to his friends as Tin Tin.
She said: “The whole town is in shock. Graeme was a well liked lad in the town.
“Everyone knows it is a great loss. My thoughts are with Graeme’s family and friends.”
