A police officer has gone on trial accused of raping a woman after she refused to join him in a “threesome”.
The High Court in Aberdeen yesterday heard that Andrew Robertson pinned down his alleged victim’s legs before raping her on a sofa.
His 30-year-old accuser also claims one of her friends – who was in her house at the time – held her arms above her head so she could not move.
The woman, who was giving evidence via video link, told the court that she had been drinking wine that evening before the pair visited her house in Aboyne.
And she said that when they got there they tried to ply her with “special champagne” before attempting to entice her into have sex with them both.
She said when she refused she was raped.
Robertson denies the allegation against him and his defence counsel Shelagh McCall lodged a special defence stating the sex between them had been consensual.
The court heard that at first the women and her friend had been drinking together without any problems on January 13, 2012.
However, shortly after Robertson entered the house with the bottle of champagne the mood changed leaving her feeling “scared and intimidated”.
Advocate depute Rosemary Guinnane, prosecuting, asked the woman what she meant by this and she replied: “They started making suggestions about having a threesome.
“I thought they were joking and just too drunk.
“They went from people that I thought were friends to behaving weird.
“It became like a little game for them and I was the toy.”
The court heard that as the mood turned “scary” the woman “did what she had to do to stay safe”.
She said Robertson and the other woman started to intimidate her into taking off her clothes.
She said she agreed to do this as she thought if she allowed them to see her naked they would stop pressurising her.
The court heard that when this was not enough for the pair they grabbed her by the arms and legs and held her down while Robertson raped her.
The woman said that after the ordeal was over he asked her friend to perform a sex act on her too, but a fight broke out between the two women, leaving her with ripped clothes and covered in blood.
The court was told that at this point the alleged victim called the police, who arrived shortly afterwards and removed the pair from her home.
However, the court heard she refused to tell the officers she had just been raped as she was worried they would not believe her.
Ms Guinnane asked the woman why she did not report the attack immediately.
She replied: “Because I knew he was a police officer. Because I knew that it was a policeman that raped me. I didn’t trust them.”
During cross-examination, Robertson’s counsel claimed the woman had made up the whole allegation and said that she had been the one to initiate the sex between them.
Ms McCall asked the woman: “Was it not more the case that you started the game of taking clothes off. You said ‘we’re all adults here, let’s have a bit of fun’.
“Didn’t you say to him ‘come on then’ and he took that as consent?”
The woman replied: “I wouldn’t touch that man if he was the last man on earth – no, this is all lies.”
The court was also shown a picture taken by Robertson, 49, on the night of the alleged incident.
The image showed the woman exposing her breast to the camera.
When asked to provide an explanation for the picture, she said she had no memory of it ever being taken.
During re-examination Ms Guinnane asked the woman what the jury of eight men and seven women should take from her evidence.
She replied: “If they want a very dangerous man off the street they will believe what I am telling you today. He’s a policeman he is supposed to protect society not commit crime.”
