An Aberdeen man who threatened to publicly post intimate videos of a former partner tried to hide his face from our photographer as he left court.
Liam Fraser told an ex-girlfriend he would upload videos he had secretly recorded of the couple to the internet when the woman moved on to a new relationship.
He sent her a video of them having sex and told her: “You’ve had your chance, these are getting posted”.
Aberdeen Sheriff Court was told his victim had no knowledge of the video being taken and did not consent.
Fraser, 20, also sent the woman a series of menacing messages with pictures and videos claiming it was her “last chance”.
He then made a number of threatening calls to the woman’s new partner stating “you’re in danger now” and that there would be “consequences”.
Fiscal depute Lydia Ross told the court at a previous hearing that following the couple’s break-up the woman received a Facebook message from a “Liam Bell”.
“It was clear to the complainer that she was talking to the accused,” Ms Ross said.
“He then sent a video which showed her carrying out a sexual act on the accused.”
A few weeks later, Fraser followed up with another message that included another video that was around two minutes long.
“The video was dark but had the sound of a female and male having sex – she recognised the sounds to be her and the accused,” Ms Ross told the court.
“She had no recollection of this video being recorded and did not give her consent.
“The accused threatened to post sexual videos of the complainer on the internet.”
Fraser told ex’s new partner ‘there will be consequences’
Fraser then sent 25 pictures and videos to the woman, adding “you’ve had your chance, these are getting posted”.
Another voice message stated: “You’re getting it. This is your last chance. You see what happens? I warned you.”
Fraser also contacted his ex’s new partner and claimed he was still having sex with her.
He followed up with calls to his ex’s new partner, stating: “Watch your back”, “You’re in danger now” and “There will be consequences”.
Fraser pleaded guilty to one charge of engaging in a course of behaviour that was abusive to his ex-partner by sending videos of her having sexual intercourse and making threats to publish images and pictures of her on the internet.
He also admitted to three charges of breaching a condition not to approach his ex-girlfriend and two charges of breaching a non-harassment order to stay away from her.
A further charge of acting in an aggressive manner towards a couple who tried to intervene to help Fraser’s ex was also admitted by him.
Alcohol and drug use
Defence agent Bruce MacDonald had previously told the court that his client “accepts entirely” he was responsible for the offences.
He added: “There is alcohol and drug use in his background.
“And he is willing to take part in an alcohol and drug programme – I think he would benefit from that.”
Sheriff Lesley Johnston told Fraser: “As you can see considerable thought has gone into your case and the impact of your actions on the complainer.
“That is because of the nature of your offending and the fact that you have a previous conviction for a domestic matter.
“I also need to consider your young age.
“You do meet the threshold for custody but I have to be sure there’s no alternative in this case.”
As an alternative to a prison sentence, Sheriff Johnston made Fraser, of Sheddocksley Drive, Aberdeen, subject to a community payback order with supervision for three years and ordered him to carry out 135 hours of unpaid work.
She also ordered him to stay away from the woman for two years with the imposition of a non-harassment order and ordered Fraser to undertake a domestic abuse programme.
