A man on trial for sexual assault yesterday took to the stand to deny the charge against him.
Karol Rozyc, 34, insisted “nothing happened” as he gave evidence during the second day of his trial at Inverness Sheriff Court.
Breaking down, he said: “I was a happy married man. Because of this, now I am divorced and only see my children at weekends.”
He admitted being very drunk, having consumed three quarters of a bottle of Jack Daniels at a party on September 1, 2013.
His alleged victim, who admitted hugging Rozyc as she consoled him about his wife being in Poland, claimed she was certain he had assaulted her.
But under cross examinationd by defence solicitor Eilidh Macdonald, she confirmed she told police she didn’t remember what exactly had happened at the time.
She told the court she had been sick, gone to the toilet and then lay on a bed. She was later joined by Rozyc who had been told by the person holding the party to either sleep on the couch or sleep beside her friend.
His DNA had been found on her private parts but not internally.
Defence DNA expert Jacqueline Marshall told the court: “His DNA could have been on her hands and when she went to the toilet, it was transferred to her groin area.
“I would have expected to find some of her DNA under his finger nails even if he had washed his hands. It would require scrubbing to get rid of it.”
However, she told fiscal Roderick Urquhart that just because none of her DNA was found on him, it didn’t mean the alleged assault did not take place.
The jury will retire this morning to consider their verdict.
