A thief breached his curfew by leaving his house in the middle of the night – claiming he was confused and thought it was daytime.
In June, Sean Paxton was ordered to remain in his flat in Aberdeen’s Stafford Street between 7pm-7am for three months, after admitting a string of thefts.
But the 49-year-old was back in the dock at Aberdeen Sheriff Court yesterday after breaching the order and heading to a nearby shop at 4am.
He claimed it was an innocent mistake and his solicitor Laura Gracie told the court: “He had been asleep, then attended the shop thinking it was the middle of the day.”
Sheriff Ian Wallace bluntly replied: “It was 4am. It was dark.”
Miss Gracie added: “He clearly should have checked the time before he left the house.”
Paxton admitted breaching his order and had his curfew extended by two weeks.
