A man who raped a woman whilst she was sleeping been jailed for six years.
Julius Derkintis ,21, attacked the female, who cannot be named for legal reasons, at a house in King’s Crescent, Aberdeen, in June 2013.
The High Court in Edinburgh heard the Lithuanian immigrant claimed the sex was consensual.
But a jury believed that there was enough evidence to convict him of sexual assault.
Temporary judge Nigel Morrison QC told Derkintis yesterday that evidence showed that he had not expressed remorse for his crime.
He added: “You have little insight into the impact that your crime has had on the woman. You display no victim empathy.
“The most appropriate sentence in this particular case is custody.”
The story emerged after Derkintis, of Victoria Road, Aberdeen, was convicted of rape at the High Court last month.
Sentence had been deferred until yesterday so that the court could obtain reports about Derkintis’s character.
During earlier proceedings, the court heard how Derkintis attacked the woman when she was fast asleep on June 24 last year. She woke up to find that Derkintis was on top of her. The offender’s legal team claimed the sex was consensual.
When the woman, who also came from Lithuania, was asked by prosecution lawyer Ian McSporran whether she had consented to giving intercourse, she said: “I don’t understand how I would be able to consent if I was passed out and unconscious. Was I in any state to give legitimate consent? I don’t think so.”
A jury then convicted Derkintis of rape. Judge Morrison also placed Derkintis on the Sex Offenders Register for life.
