Airport worker who was ‘too upset’ to give breath sample after crash

An airport worker who crashed her car “begged” for the police not to be called then failed to give a usable breath sample because she was “too upset”.

Nicole Boyne crashed her car into the back of another vehicle in Powis Terrace, Aberdeen, before pleading that the other driver not call the police at around 11.30pm on January 25.

After smelling the alcohol on the 32-year-old’s breath they immediately called the cops and a roadside breath test gave a positive result, Aberdeen Sheriff Court was told.

Fiscal depute Tom Procter said: “She was involved in a car accident where she collided with the rear of another vehicle at a red light junction.

“The other driver noted that the accused begged her not to go to the police.

“She noted she appeared under the influence of alcohol and so she called the police.”

He added that Boyne, who was driving a silver Audi, at first agreed to give a further oximeter machine sample at Kittybrewster police station but failed to give two samples before the machine timed out.

Representing herself in court, an emotional Boyne said she “struggled to give two samples because she was really upset” at having taken the “stupid” decision to get behind the wheel after drinking.

“I understand the severity of my choices and what I did,” she said. “I really regret what I did. I regret this every day.”

Boyne, of Stenhousemuir, now fears she’ll lose her job of three years at Edinburgh Airport given the mandatory driving ban which goes hand-in-hand with such offences.

“I love my job,” she added. “I worked so hard to get it. I work unsociable hours and rely on my car to get to work.

“I will obviously struggle to keep my employment. I can only hope I can speak to my employer and keep my job.

“It was the most stupid decision I have ever made.”

She admitted a charge of failing, without reasonable excuse, to provide a specimen of breath.

After sobbing in the dock, Boyne, of Inchcolm Avenue, Larbert, was banned from the road for 12 months and fined £290.
