A Peterhead man who was ordered not to approach his girlfriend was caught by police hiding under a blanket at her home less than 12 hours later.
Sean McKay was found by police at the woman’s address in Peterhead despite being made subject to a condition not to approach or contact her or enter her home on the same day.
The 27-year-old was ordered on Monday not to go near his partner but was found by police hiding in her home at around 10:50pm that same day.
McKay’s own solicitor described the offence as an “egregious” breach of an order by the court.
He pleaded guilty at Aberdeen Sheriff Court to one charge of approaching the woman without a reasonable excuse and therefore breaching an order put in place at Peterhead Sheriff Court.
‘This is going to be quite an expensive mistake for you’
Fiscal depute Sean Ambrose told the court that on the same day the order had been put in place, police attended at the woman’s address to pass on details of McKay’s bail to her.
He said: “Police were afforded entry to the property and found the accused within, hiding under a blanket in the bedroom.
“He was thereafter cautioned, arrested and charged regarding the contravention and thereafter conveyed to Fraserburgh police station.”
‘He knows he was wrong in being there’
Defence agent John McLeod called McKay’s decision to flout his bail condition so quickly an “egregious” breach of the order.
He added: “What has happened is that neither party wanted these bail conditions, including the complainer.
“He knows he was wrong in being there because he is the one on bail and not her.
“I have had a fairly direct conversation with him this morning as a result of which he appreciates now the situation he is in.”
Sheriff Graham Buchanan described McKay’s actions as a “pretty blatant breach of the bail conditions” on the same day they were implemented.
“This is going to be quite an expensive mistake for you,” he said.
Sheriff Buchanan fined McKay, of Berryden Road, Peterhead, £320.
