A man found guilty at trial of sending indecent images and making threats to rape a woman has avoided imprisonment.
Ovidiu Pirva also shared intimate photos of the woman by phone messages and by posting them on social media.
He sent the photos to a child and also made threats to rape their mother and sister in another message.
The 28-year-old denied the offences, which happened on January 20 2018 at an address in Aberdeen.
Found guilty at trial
But he was found guilty by trial earlier this year of two charges of threatening and abusive behaviour, one of threatening to and sending indecent images, and another of causing a child to look at those images.
He has now been placed on the Sex Offenders Register for two years.
His defence agent Bruce MacDonald said Pirva has spent the last two months setting up a successful landscape design business which would suffer should he be sent to prison.
“The alleged offences were four years ago and there’s no previous sexual offending before that evidence and nothing since,” he said.
“The victim said she has forgiven him and has moved on from all this herself.”
Sheriff David Hall, who presided over the trial, wished Pirva well with his business and said since the offences were four years ago and he hadn’t offended before or since he wouldn’t be sending him to jail.
‘You have moved on with your life’
“Your behaviour on the day in question towards the complainers was simply not acceptable,” he added.
“And you should be in no doubt that the court views this type of offending very seriously.
“However the offence happened four years ago and it appears that you have moved on with your life.
“I also note the attitude of the complainer who appeared from her evidence to have forgiven your behaviour, although it’s clear that (the child) has not.
“I have decided I can deal with you in such a way as to allow you to remain at liberty.”
Placed on register
He handed Pirva, of Leyland Walk, Bristol, a community payback order comprising two years supervision, 160 hours of unpaid work and a requirement to take part in the Building Better Relationships programme.
Pirva was also handed a two-year non-harassment order and placed on the Sex Offenders Register for two years.
