A driver who was behind the wheel of a disabled vehicle has been fined after he pulled out into the middle of a dual carriageway and caused a crash.
Gair Mackay, 71, drove across lanes on the A92 near Portlethen which resulted in his car colliding with another vehicle – and him with broken ribs and a ruptured spleen.
The couple who were in the car Mackay collided with were also taken to Aberdeen Royal Infirmary after sustaining minor injuries.
Fiscal depute Alan Townsend told Aberdeen’s Justice of the Peace court that as the couple were travelling on the A92 on New Year’s Eve 2021 and saw Mackay’s vehicle “pull out and drive across the dual carriageway”.
He added that they were unable to avoid crashing with Mackay’s car, which caused “significant damage” to both vehicles.
Mackay, of Glebe Court, Portlethen, admitted driving without care and attention and was handed four penalty points on his licence and a £230 fine.
Teenager snapped parking barrier
A man has been fined after he caused more than £1,000 worth of damage when he snapped a parking barrier.
Scott Burgess, 18, pulled at the barrier that lets vehicles in and out of College Street car park in Aberdeen causing it to bend and break.
The JP Court heard that in the early hours of Christmas Eve 2021 Burgess “pulled at the electric barrier” with such force it snapped in two.
The cost of the damage and repairs totalled £1,045, with labour costing £564.
Burgess, of Spey Road, Aberdeen, was fined £210.
Driver veered into other lanes while on phone
A driver has been handed a fine and penalty points after police caught him using a mobile phone while driving.
Gareth Findlay, 42, was spotted by police veering between lanes on the A92 near Marywell while the road was slick with rainwater on December 27 last year.
When officers on mobile patrol pulled up alongside Findlay, they saw he was on his mobile phone.
Fiscal depute Alan Townsend said: “The officers deemed him not being in control of his vehicle because he was using a phone”.
When stopped by officers, Findlay claimed he was just trying to unlock the phone on his lap.
Findlay, of Crawhill Drive, Glasgow, was given four penalty points and fined £230.
BMW driver drove at excessive speed
A BMW driver has been fined after he was caught driving at an excessive speed on a dual carriageway.
Andrew Doherty, 42, was spotted by a speed detection device driving his BMW X3 Sport vehicle on the A956 North Esplanade West, Aberdeen, doing 44pmh in a 30mph zone.
His solicitor George Mathers told Aberdeen Justice of the Peace Court that Doherty thought he was driving in a 40mph zone at the time.
Mr Mathers also asked the court to be “sympathetic” as Doherty had initially attempted to pay the fine but had forgotten to enclose the cheque.
Doherty, of Braehead Drive, Stonehaven, was handed three penalty points and fined £110.
‘Naive’ driver sped off after collision
A new driver who drove off after colliding with another motor vehicle has been fined and given penalty points on her licence.
Louise Stephens, 18, collided with a car on Abbey Square, Aberdeen, but left the scene and failed to give her details to the owner of the other vehicle on January 4 this year.
Her solicitor, Ian Woodward-Nutt, told the court that the healthcare support worker drove away on the evening in question out of “naivety”.
He added: “She didn’t know to make some enquiries but she accepts that she is guilty.”
Stephens, of Loirston Way, Cove, Aberdeen, was handed five penalty points and fined £265.
Teen behind wheel only had provisional licence
A driver who was caught behind the wheel of a car at a park and ride facility was found to only have a provisional driver’s licence.
Jordan Bennett, 19, was questioned by police officers on Exhibition Avenue, Bridge of Don, Aberdeen, after he was seen driving a vehicle on February 17 this year.
A subsequent check by police showed that Bennett only had a provisional licence and no insurance.
Bennett, of Oldcroft Place, Aberdeen, was handed seven penalty points and fined £510.
Woman left scene of accident
A woman who left the scene of an accident to attend a doctor’s appointment has been fined and handed penalty points on her licence.
Oana Fita, 32, appeared in the dock at Aberdeen Justice of the Peace Court and admitted failing to report a collision and driving off without leaving any details.
The court heard it was a local shop assistant who reported the damage that Fita’s Hyundai caused to a grey MG on Greenfern Place, Aberdeen, on November 2 last year.
Fita, of Sheddocksley Drive, Aberdeen, told the court that she knows she “made a mistake” but “didn’t know exactly what to do”.
She was handed six penalty points and handed a £510 fine.
Kemnay driver had no insurance
A Kemnay man who was stopped by police was found to be driving without insurance.
Darren Howie, 51, was pulled over on Main Street, Alford, and a check showed that he had no current insurance policy for the vehicle.
Fiscal depute Alan Townsend told Aberdeen Justice of the Peace Court: “They spoke to the accused who believed he had insurance but wasn’t able to produce it at that time and claimed he was moving house.”
Howie’s solicitor, George Mathers, told the court that his client had insurance for his previous car and and assumed it would pass on to his new one.
Justice of the Peace Peter Robinson described having no insurance while driving a vehicle as a “pretty serious situation”.
He fined Howie, of Craigearn Park, Kemnay, £370 and handed him eight penalty points.
Woman drove off after supermarket collision
A driver who drove off after colliding with another vehicle in a supermarket car park has been fined and given penalty points on her licence.
Kayleigh Matthews, 22, had attempted to manoeuvre her car into a parking space at Asda Gathdee but instead caused scratches and damage to another vehicle.
Aberdeen Justice of the Peace Court heard that instead of leaving details for the owner of the scratched vehicle, Matthews drove off.
She also admitted to failing to report the incident on November 28 last year.
Matthews, of Links View, Aberdeen, was handed six penalty points and fined £440.
