A drugged-up man found “slumped” over the footwell of his car has been banned from the road.
Ian Kelman, 56, was spotted by police within his car with the engine running and his headlights on but slumped across the passenger footwell.
When officers approached his car on Provost Rust Drive he was unsteady on his feet and confused, Aberdeen Sheriff Court was told.
Fiscal depute Andrew McMann said he came to the attention of officers who were on mobile patrol at around 9.20pm on May 28, last year.
Found ‘slumped’ in car
“The car was parked however had brake lights and headlights on,” the fiscal said.
“They observed the accused to be leaning or slumped over into the passenger side footwell of the vehicle. The engine was still running.
“They found him to be intoxicated, to have dilated pupils, impaired balance, confusion and slurred speech.”
A blood test showed he had 74mcg of digested cocaine in one litre of blood, the legal limit being 50mcg.
Kelman admitted a charge of being in charge of a vehicle while unfit through drugs.
Kelman’s defence agent Neil McRoberts said non-prescription drugs had been taken by his client that day but that he had not consumed cocaine.
He had, however, taken the Class A drug the day before.
“He has previous convictions and drug matters on his record, but no convictions for drugs involving driving before,” the solicitor added.
The court was also told Kelman, of Deer Park Grove, was banned from driving shortly after this incident after he failed to carry out a DVLA-ordered medical assessment.
Sheriff Eric Brown suggested the circumstances of the offence pointed towards a drug-driving offence before banning him from the roads for eight months and fining him £320.
