A man who poses a sexual risk to women has been fined after he showed pornographic material to a female stranger in the street.
James Govan, 30, admitted showing the woman a pornographic video on his mobile phone as she crossed at traffic lights in Aberdeen.
The woman, who was not known to Govan, was walking alone after finishing work in the Rosemount area of the city.
Aberdeen Sheriff Court heard that Govan was already subject to a Sexual Prevention Order, which prohibits him from communicating with women.
He was made subject to the order at Dundee Sheriff Court on October 27 last year – less than five months prior to this incident.
Govan was also on bail at the time.
Accused held phone so woman could see it
Fiscal depute Jennifer Pritchard told the court that at around 5.30pm on March 8 this year the woman was walking home after work near Skene Square in Aberdeen.
She said: “Whilst crossing at the traffic lights she saw the accused walking towards her crossing in the opposite direction.
“She saw that he had his mobile phone in his hand at around waist height and with the screen pointed in her direction.
“It displayed a pornographic video.
“The complainer then verbally challenged the accused, but both continued to walk in their respective directions.”
Upon a complaint being made by the woman, police officers found CCTV that showed the incident and Govan was identified.
He pleaded guilty to one charge of breaching a Sexual Prevention Order by approaching a lone female and showing her pornographic material on his mobile phone.
‘Level of planning’ involved
Govan, who represented himself at court, offered no mitigation on his own behalf.
Sheriff Lesley Johnston told Govan: “There was a level of planning involved in this incident.
“You made the decision to instigate the contact and to approach the complainer.
“However, I accept that there wasn’t any long-term planning.”
Sheriff Johnston imposed a fine on Govan, of Gilcomston Park, Aberdeen, of £420.
