An Aberdeenshire man touched a woman’s buttocks in a bar after his attempts at flirting and chatting about football did not impress.
Gavin Cutter, 44, tried unsuccessfully to talk to a woman and her friends, who were enjoying an afternoon out at The Market Bar in Stonehaven.
After his attempts failed, the civil engineer continued to drink heavily for several hours then later approached the woman and committed the offence.
He then became aggressive with other customers and was ejected from the premises.
A friend of his victim reported Cutter to the police a few days after the incident.
His defence agent said Cutter recognised his threatening and abusive behaviour was “absolutely disgraceful” and that he had behaved “like an idiot”.
‘Touched the woman on the buttocks’
Fiscal Emma Petersen said Cutter first tried to chat to the woman and her friends around 2.30pm on May 31 at the bar last year.
The fiscal told Aberdeen Sheriff Court: “The complainer was at the bar and the accused had a conversation about football and continued to try and engage with the woman or her friends.
“The woman tried to ignore the accused. Then later, at 8pm, the woman was standing at a table with her back to the bar talking to her friends when she became aware the accused was standing behind her.
“The accused then touched the complainer on her buttocks.”
The woman turned around and told him to leave and Cutter responded by going to sit down at the bar. He was told again to leave the woman and her friends alone.
The fiscal added: “One of her friends saw that the accused had become aggressive in his demeanour to other people there.”
At 8.15pm the woman left the bar and Cutter was ejected from the premises not long after due to his behaviour.
‘Behaved like an idiot’
Defence agent Alistair Thomson said Cutter had been “drinking heavily and spending rashly” on the afternoon of the incident. By 7.50pm, he had become uncontrollable.
Cutter watched the CCTV footage taken from that afternoon and said he recognised his behaviour was “disgraceful” and he had “behaved like an idiot”.
Due to the amount of drinks he consumed, Cutter has no recollection of the event.
Sheriff Andrew Miller said it was “clearly a very unpleasant course of conduct” and fined Cutter, of East Vines, Sunderland, £320 to be paid over two months.
