A fish factory worker has lost his driving licence after police spotted him answering a call from his mum while behind the wheel.
Damian Zielinski, 21, was seen holding his phone while driving South Esplanade West in Aberdeen.
And when officers pulled him over, they also found him breaching bail conditions to keep away from his partner, who was in the passenger seat.
Fiscal depute Tom Procter told Aberdeen Sheriff Court: “Around 2.20pm on April 30, police were on mobile patrol and observed the accused driving the vehicle in question.
“He was seen to hold a mobile phone in his right hand, pressing buttons on it.”
The vehicle was stopped, and checks revealed Zielinski was in breach of a bail condition by being in the company of his passenger.
Accused was ‘driving out of town to try and avoid detection’
Zielinski, of Farquhar Road, Aberdeen, pled guilty to driving while using a mobile phone and breaching a bail condition.
Defence agent Chris Maitland said: “After the incident that led to him being on bail, the complainer contacted him asking for an explanation for what he did.
“He asked could he meet with her to explain and apologise. She agreed.
“On this day, they were driving out of town to try and avoid detection.
“His mother phoned and he answered the phone and was seen doing that.”
Mr Maitland explained his client, a fish factory worker, was a new driver and so would have his licence revoked as a result of the offence.
Sheriff Eric Brown handed him six penalty points and a £330 fine.
