A north-east personal trainer threatened to “cripple” his ex-girlfriend’s husband in a series of chilling and violent messages to the mother of his son.
Scott Allan, of Sluie Drive in Dyce, threatened to burn down his ex’s home if she didn’t respond to abusive messages he sent over the Christmas period.
He then sent her a picture he took of the cul-de-sac she lives on with her family.
The 44-year-old also claimed he would rip his ex’s new husband’s face “clean off” and “break his legs”, and believed she had “poisoned” his son against him.
Forfar Sheriff Court heard that Allan left multiple voice mails, warning of extremely violent acts he would carry out if he wasn’t allowed to see his son.
Allan has now been banned from contacting the woman or entering the new housing development in the town that she moved to from Aberdeen.
Depute fiscal Elizabeth Hodgson told the court: “The accused is the ex-partner of the complainer.
“They were in a relationship for three years and have a son together.
“The complainer has remarried.
“She was pregnant at the time of the offence.
“At around 2.55pm on November 3, the complainer received a text saying ‘I’ll find your door within hours’ and ‘I believe congrats is in order’.
“He also said: ‘I want to see my son’ and ‘if my son says he does not want to see me, you’ve poisoned him against me’.
“He then said, of her husband: ‘I am going to snap his legs. Get in touch if you don’t want your man crippled’.”
Vile threats of violence
The fiscal continued: “At 12.30am on December 27, the complainer received a voicemail.
“She recognised it as the voice of the accused.
“She heard him say: ‘Get in touch with me as soon as possible. I f****** mean it.
“If you don’t, I will come down next week and rip your husband’s face clean-off or break his legs.
“I want to see my son.
“Get in touch or I will burn your house down’.
“On January 3 this year, the complainer received various messages from Allan, including an image of the cul-de-sac she lives on with her family.
“She contacted the police and showed them the message.
“On January 27, police traced the accused and arrested him.
“He made no comment on being cautioned and charged.
“The complainer is extremely supportive of a non-harassment order.”
‘He does regret his actions’
In mitigation for Allan, defence solicitor Nick Markowski said: “He anticipated she would want a non-harassment order.
“He is 44, he is the father of seven children.
“Previously the complainer lived in Aberdeen, he exercised family contact up until the first lockdown.
“She relocated to Arbroath and initially there was some communication but he was not getting any contact with his son.
“He felt there was parental alienation going on.
“He accepts when he sent the abusive messages he began to commit an offence.
“The complainer did not block his number or report them to the police.
“He felt emotional after Christmas.
“He does regret his actions.
“He was in Dundee and headed back to Aberdeen (when the picture was taken).
“He travelled via Arbroath and found the address.”
Alternative to custodial sentence
He added: “He is appropriating some of the blame on the circumstances.
“He is a personal trainer. He is aware he has put his liberty at risk.
“He does have a record but it has slowed down.”
Sentencing Allan, Sheriff Alison Michie said: “You have a lengthy record which dates back to 1997.
“There are offences of violence and domestic abuse.
“I am prepared to follow the recommendations in the report and impose a community payback order.
“I take into account you care for four children.
“This is an alternative to a custodial sentence.”
Allan will spend two years on supervision and must complete 200 hours of unpaid work.
He is also subject to a non-harassment order against his former partner for a two-year period.
