Woman returned from holiday to find angry ex had moved back in

A woman returned from holiday to find her ex-partner had moved into her flat where he ripped the intercom system off the wall when asked to leave.

Mariusz Moczulski, 47, appeared in the dock at Aberdeen Sheriff Court and admitted using the spare keys his ex-partner had given him to her flat in Torry, Aberdeen.

When she told him to leave and locked him out he pulled her intercom system from the wall and verbally abused her.

Moczulski pleaded guilty to one charge of recklessly destroying property by pulling the intercom system from a wall and breaking it.

He admitted a further charge of behaving in a threatening or abusive manner.

‘No right to be there without permission’

Fiscal depute Eabha Sweeney told the court that the couple had been in a relationship and lived together but that in April this year they broke up and the woman moved out.

Moczulski had retained a key to her property but had “no right to be there without permission”, Ms Sweeney said.

The pair had both visited Poland to visit family and friends but had returned on separate flights to Edinburgh International Airport.

However, they were coincidentally on the same bus back to Aberdeen but travelled separately.

Ms Sweeney said: “The complainer returned home, unlocked her door, and noticed that the accused’s travel bags were in the hallway.

“She then saw the accused outside her front window and locked her flat door. The accused being in possession of a key gained entry to the property.

“At this point, he pulled the intercom system from the wall. He then called the woman a ‘slut’ and a ‘whore’,” Ms Sweeney said.

While in “a state of fear and alarm,” the court heard the woman slapped Moczulski across the face and informed him she would call the police.

When he still refused to leave, the woman called the police to report the incident.

As police arrived the woman was found to be crying and in a state of shock.

Accused was verbally abusive

Officers traced and arrested Moczulski who made admissions during an interview to damaging the intercom and being verbally abusive to the woman.

Defence agent Iain Hingston told the court that his client claimed that the woman became aggressive and Moczulski had “behaved in the same way”.

He stated that Moczulski has no previous convictions and claimed the pair were “still in a relationship”.

Sheriff Lesley Johnston fined Moczulski, of Grampian Road in Aberdeen, a total of £345.
