A noisy neighbour was arrested when he tried to kick down the door of the man who complained… while police were inside investigating the offence.
Daniel Mlynarski struck the door so hard he broke the latch and when police officers opened it they saw he held an empty glass bottle in his hand.
In a separate incident, Mlynarski, 24, was banned from driving after he was found to be behind the wheel while nearly six times the cocaine limit.
Police opened door to find accused
Fiscal depute Nicole Lewis told Aberdeen Sheriff Court that on March 12 this year Mlynarski had been drinking and playing loud music at the flat on Virginia Court in Aberdeen.
She said: “A neighbour attended at the property and asked him to turn it down.
“The complainer then contacted the police about this and officers attended.
“While speaking to the complainer, police officers heard continuous banging at the door which was so hard it caused the latch to break.
“The police opened the door to find the accused kicking the door and holding a glass bottle.”
Mlynarski, who has a number of previous convictions, admitted acting in a threatening manner by repeatedly kicking his neighbour’s door.
He also admitted to driving a car with a cocaine metabolite in his system on May 25 2020.
When tested by police the amount of Benzoylecgonine – the breakdown compound of cocaine – in his blood was 294 microgrammes per litre. The legal limit is 50 microgrammes.
Sheriff warns accused to be ‘very careful’
Defence agent David Sutherland told the court that his client had provided a “positive background report” to social workers.
However, he added that Mlynarski had “clearly relapsed into alcohol and drug misuse”.
Sheriff Graham Buchanan warned Mlynarski to be “very careful” in terms of the number of convictions he currently has.
He added: “It’s getting to the point where the court will have no option but to sentence you to prison.”
Sheriff Buchanan sentenced Mlynarski, of North Balnagask Road, Aberdeen, to a community payback order with supervision for 18 months and ordered him to carry out 180 hours of unpaid work.
He also banned Mlynarski from driving for 21 months.
