A man has been jailed after he barged into a friend’s home and attacked him before taking his PlayStation.
Lee Jarvie burst into the man’s flat and attacked him as he lay defenceless on the floor before dragging him into his living room and continuing the vicious assault.
Aberdeen Sheriff Court heard that the 29-year-old grabbed the man’s games console before telling him: “That’s it. Your debt’s cleared.”
Jarvie also stole the man’s bike from the hallway as he left the property.
Accused kept shouting that man owned him money
Fiscal depute Brain Young told the court that at around 10am on November 5 last year the complainer was in his home at Bayview Court in Aberdeen when he heard a loud banging on his front door.
“On opening the front door the complainer was struck by another party causing him to fall to the floor,” he said.
“Whilst on the floor, the accused punched him to the head and kicked him on the body.
“He then pulled him up from the ground and dragged him into the living room and onto the sofa where he continued to punch him to the face.
“During the assault, the accused kept shouting at him that he was due money.”
Javie then started pulling at the man’s games console and began unplugging the wires from the wall while wrapping up the control pads.
Before leaving the property, he turned to the man and said: “That’s it. Your debt’s cleared.”
However, the man later realised that Jarvie had taken his Carrera bicycle from the hallway as he left the flat.
The victim was taken to Aberdeen Royal Infirmary where he was found to have suffered a broken nose, lacerations to his face and bruising at various points on his body.
Jarvie pleaded guilty to one charge of assault and robbery.
Sheriff considered longer sentence
Defence agent Michael Horsman told the court that his client “does have a number of previous convictions dating back to 2010” including some for assault.
“This is a serious offence that Mr Jarvie has committed and he does accept that it’s a serious offence,” he said.
“The two men had been friends and there was a falling out at some point where they sent some abusive messages back and forth.
“But Mr Jarvie fully accepts that none of this justifies what he has done and he does express regret.”
Sheriff Morag McLaughlin told Jarvie: “You pleaded guilty at the earliest opportunity and had you not done so I would have sentenced you to two years in prison.”
She sentenced Jarvie, whose address was given as HMP Grampian, to 16 months in prison, backdated to November 17 last year.
