A paedophile pensioner has avoided a prison sentence despite being caught with more than 100 indecent images and videos of children he downloaded from online chatrooms.
Marek Rosiak was caught after the National Child Abuse Inquiry received intelligence that indecent images of children had been uploaded from his address.
Aberdeen Sheriff Court heard police found Rosiak with more than 100 vile sexual images of underage youngsters on a tablet in his home in Turriff.
As well as more than an hour and a half worth of sickening videos, the 74-year-old first-offender also had a chat thread on the app Telegram containing child images.
A number of images and videos involving animals and “sadistic sexual activity” were also discovered.
Fiscal depute Lynne MacVicar told the court the National Child Abuse Inquiry received intelligence that a device at Rosiak’s address had been used to upload indecent images of children to the internet.
A search warrant was executed just over a week later, on February 17, while Rosiak was at home and an Acer tablet device was seized.
Ms MacVicar said: “Upon examining the tablet, indecent images of children were found and the accused was cautioned and arrested and taken to Kittybrewster station.”
Further examination of the tablet later revealed downloads, Telegram folders, and a chat thread containing indecent images and videos of children.
In total, just over 100 images and videos were discovered, the majority of which were category C, but including some which were category A, the most serious.
The videos had a total run time of more than an hour and a half.
Rosiak, of Station Road, Turriff, pled guilty to taking, permitting to be taken or making indecent images of children, and possession of indecent images of children.
‘These are serious offences’
Defence agent Stuart Beveridge told the court that his client explained in his social work report that he had accessed the indecent images through “various chatrooms”.
“He no longer accesses these chatrooms,” Mr Beveridge added.
“Mr Rosiak is assessed as being of a low risk of re-offending and it is suggested that he may benefit from the period of supervision.”
Sheriff Philip Mann told Rosiak: “I hope you understand that these are serious offences.
“It is concerning that the run times of these videos are quite lengthy and if it had been a higher amount of images I would have been considering a custodial sentence.
“But I’m not going to go down the route today.”
As an alternative to a prison sentence, Sheriff Mann ordered Rosiak, of Station Road, Turriff, to undertake and community payback order with supervision for two years and pay a £500 fine.
He also placed the pensioner on the sex offenders register for five years.
