A drunk man who police were escorting home has been jailed after he made threats to have them assassinated.

Jay Jay Kirton, 31, was reported to police after he was seen banging on the windows of a KFC restaurant in the early hours of December 3 last year.

When officers arrived, they planned to take Kirton home but he soon turned on them and spat at one before making threats to cut another’s throat.

Aberdeen Sheriff Court heard Kirton then went on to make a threat to “bomb” a constable’s home and hire individuals to “shoot” two police officers.

Accused was behaving ‘highly erratically’

Fiscal depute Carol Gammie told the court that at around 7.25am on December 3 2022, police were called by staff at KFC on Great Northern Road over concerns for a man who was banging on their windows.

Kirton was traced to Haudagain Retail Park where he has behaving “highly erratically and made little sense”, Ms Gammie said.

She added: “Police officers ushered that accused into their marked police van with the intention of taking him to a family member’s address.”

However, as soon as the van set off Kirton began being abusive and making threats to “smash” one officer’s face in and “slit his throat”.

He made this statement while dragging his thumb across his throat.

The van was stopped on Esslemont Avenue, Aberdeen, where Kirton was cautioned, arrested and charged and informed he would be taken to Kittybrewster Police Station.

Homophobic slur

Kirton then began removing items from his pocket and the police van again had to be stopped as officers attempted to pick them up off the floor.

As they were doing this, Kirton punched one officer in the face and barged past officers in an attempt to escape.

He was caught a short distance away, where he attempted to spit on an officer but missed.

As the van arrived at Kittybrewster Police Station, Kirton shouted threats that he was going to “bomb” one constable’s home and “get individuals to shoot” two other officers.

Kirton then made further threats to “punch” the officers before headbutting one constable to the wrist causing him to feel “a sharp pain”.

While at the police check-in desk, Kirton made a homophobic slur against a number of officers.

Kirton pleaded guilty to one charge of behaving in a threatening or abusive manner and two charges of assaulting police officers.

Offence occurred only days after release

Defence agent Caitlin Pirie told the court that when her client was picked up initially by police he “hadn’t done anything wrong”.

But she added: “The police officers were only trying to help him and then he behaved in this unacceptable way.

“He knows that he shouldn’t have done it.”

Sheriff Philip Mann told Kirton that due to these incidents taking place “only days after” he was released from prison, he felt it was only appropriate to send him back to custody to serve the unexpired portion of his sentence.

He also added a further year and nine months to his sentence.

The sheriff jailed Kirton, whose address was given as HMP Grampian, for a total of 26 months.
