A father-of-three who threatened to “burst” his neighbours and “boot them up the street” has been admonished.
Maxi Duncan hurled various threats in Portsoy’s Murray Place during the lunchtime disturbance on March 16 2020, Banff Sheriff Court was told.
The incident was sparked by a fallout over the rental of a horse yard.
The 32-year-old was admonished after other members of his family, due to stand trial for further alleged offences, had their cases deserted.
Fiscal depute Ellen Barr said Duncan came out of his own house “shouting and threatening to commit an assault”.

“He went on to threaten them stating that he would ‘burst them’,” she said.
“He continued to variously threaten the witnesses saying to his neighbour ‘Get your daughter under control or I will boot you both up the street’.
He also said ‘I will put the head on her. I will f****** burst you’.”
The incident was recorded on someone’s mobile phone and Duncan pled guilty to behaving in a threatening or abusive matter.
The unemployed dad’s defence agent Stuart Beveridge said the fallout was over unpaid horse yard rent and other debts.
He said one complainer had “repeatedly breached the terms of their contract” over a yard she rented for horses from Duncan, while the other complainer was due Duncan money.
Handed admonition from sheriff
“He was basically retaliating to things that were said to him,” the solicitor added. “He tends to keep himself to himself, has anxiety and doesn’t cope well with stressful situations.”
Sheriff Robert McDonald said this had been “hanging over” Maxi Duncan, of Murray Place, Portsoy, for three years and so handed him an admonition.
