An Aberdeen stalker who forwarded an image of herself carrying out a sex act on a man has been let off by a court.
Toni Nicol harassed her victim by calling him more than 50 times in one morning and threatening him saying “It’s about to get worse if you don’t call me”.
As calls and messages flooded the man’s phone, the 31-year-old threatened to smash up his car and “burn his mum’s house down”.
In a strange twist, Aberdeen Sheriff Court heard Nicol even sent a picture of herself performing oral sex on another man.
Toni Nicol: ‘I do not take well to being made a fool of’
Fiscal depute Tom Procter told the court at a previous hearing that Nicol had just one meeting with her victim and said it was “just a potential relationship” that never materialised.
Following this, the man messaged Nicol in early November last year to tell her he did not want to pursue a romantic relationship.
While at work on November 15, the man saw he had 51 missed calls and further messages on WhatsApp calling him a “scumbag” and one stating: “I do not take well to being made a fool of.”
“She then sent a picture message of her performing a sex act on another male,” Mr Procter said.
“He messaged the accused saying they should go their separate ways, but the messages continued with the accused stating: ‘I do not give a f***. It’s about to get worse if you don’t call me’.”
As the man advised Nicol that he would not be calling her back, he then received a further 17 missed calls and blocked her from WhatsApp.
Nicol then sent her victim an SMS text message stating: “You still do not give a f***, you’re like all the rest.”
The man then received multiple further calls and messages from Nicol where she threatened to “smash up his car” and “burn his mum’s house down”.
She also made threats to get other people to assault him who “wouldn’t stop until he stopped breathing”.
Upon receiving these messages, the man blocked her entirely from his phone and contacted the police.
Nicol admitted one charge of carrying out a course of conduct that caused fear and alarm and of making threats to harm the complainer’s family.
‘I’m sure you regret this incident’
Defence solicitor John Hardie told the court it was clear his client had committed this offence while suffering from an “undiagnosed complex”.
“She was described at the time as being manic,” he said.
“The medication she was on was incorrect and now she is on the correct medication – the situation is now chalk and cheese from what it was.
“Due to this, the process has ultimately been of benefit to her.”
Sheriff Margaret Hodge told Nicol: “I’m sure you regret this incident but I do accept that your medical health may have contributed in some way.”
She admonished Nicol, of Sandilands Drive, Aberdeen.
