A revolting man who attacked a supermarket security guard went on to tell a police officer: “I’ll rape your wife and kids” – then laughed.
Marcus Capp, 29, made vile threats to officers who approached him after he assaulted a supermarket security guard, who the offender called a “black s***”.
Capp also warned: “I’m going to f*** you up” and told them he would “have his friends at Barlinnie do you in”, during the incident near Tesco Inshes in February of this year.
He pled guilty to charges of threatening and abusive behaviour, assaulting the guard and making racially aggravated comments and assaulting two police officers.
Capp also admitted separate charges of threatening and abusive behaviour and assaulting a police officer at Sainsbury’s in Nairn on August 30th last year.
‘The accused challenged them to a bare-knuckle fight’
Fiscal depute Emily Hood told Inverness Sheriff Court that, on the earlier occasion, police received a call about a man’s behaviour on the Balmakeith business park.
When they arrived, Capp was compliant at first as he sat in a police vehicle.
But when a police records check revealed that Capp had an outstanding warrant ordering his arrest “his demeanour changed from compliant to aggressive”.
He then picked up a bottle from his belongings.
“He has raised the bottle and told the officers that he would not be getting handcuffed and that, if they came near him, he would bottle them,” Ms Hood explained.
“The accused ignored repeated requests by officers to drop the bottle and challenged them to a bare-knuckle fight,” she added.
Officers called for backup and when it arrived Capp was arrested, but as he was handcuffed, he bit an officer’s hand – leaving a graze.
‘I’m going to rape your wife and kids’
Then on February 22 of this year, a security guard at Tesco in Inshes noticed Capp harassing customers outside the store as he begged them for money.
When he asked him to leave, Capp became aggressive – running at the man and calling him a “black s***” before hitting him in the chest.
Police were called and traced Capp nearby, but when officers approached him, he started shouting threats.
They included: “I’m going to rape your wife and kids” and “I’m going to f*** you up”.
As he was arrested, he spat at one officer – repeating his threats of sexual violence – and said he would “get his friends at Barlinnie to do you in”.
While he was being put in the cage of the police van, he kicked out at a second officer – catching him on the wrist.
” As the door was being shut, the accused was heard to be laughing by the officers,” Ms Hood said.
Capp self-medicated by ‘drinking into oblivion’
Solicitor Rory Gowans, who represented Capp, said his client had been homeless for seven years.
He told the court that Capp suffered from a number of health issues – including PTSD, depression, anxiety and ADHD – that are now being treated with medication.
Mr Gowans explained that Capp had previously self-medicated by “drinking into oblivion, which was what has happened here on both occasions”.
The defence lawyer added: “He struggles with his mental health and he reaches for alcohol to cope”.
Mr Gowans said Capp was “ashamed of his conduct” and “apologetic”.
But Sheriff Sara Matheson jailed Capp, whose address was given as being a prisoner at HMP Inverness, for 12 months.
The sentence was backdated to February 23 of this year.
