A 29 year old Easter Ross man is on trial at Inverness Sheriff Court accused of assaulting a woman with intent to rape her.
Stuart Sutherland, who lives in Invergordon but is described as a prisoner at Inverness denies that on January 13 this year at an address in Joss Street, he seized her by the wrists, carried her into a bedroom, seized her by the throat which restricted her breathing, stripped her naked, all to her injury and with the intent to rape her.
He also denies behaving in a threatening manner towards Michael Kay by pushing him on the body and throwing clothing at the woman.
He has also pleaded not guilty to resisting arrest and struggling with two police officers who detained him at the house.
Mr Kay told the jury of nine women and six men that he had been at a party in the house and was drunk.
“I remember Stuart and the woman going upstairs and there was a lot of shouting and swearing.
“I went up also to go to the bathroom and Stuart came out holding the woman by the wrists and they went into the bedroom.
“She was shouting for him to get off her. I went to the doorway and saw her kneeling at one end of the bed only wearing her underwear and Stuart was at the other end.
“Then he threw what I think was a dressing gown at her. He then pushed me on the arm and told me to leave.”
In evidence, the alleged victim said she and Sutherland had argued.
She confirmed that Sutherland had removed a pair of track suit trousers from her but that they belonged to him.
The woman added: “I think he was trying to humiliate me.”
