A man who stumbled from his car after being caught driving erratically along a Moray road – and then refused to complete a police breath test – has been banned from driving.
Liam Davenport was spotted “veering and weaving” his Vauxhall Vectra across St Paul Street in Buckie on Saturday, May 23.
Elgin Sheriff Court heard yesterday that when he was pulled over by police at about 10pm, his eyes appeared to be “glazed over” and he struggled to speak clearly.
Fiscal depute Kevin Corrins said: “The car belonging to the accused continually slowed down and then sped up, and was veering and weaving across the carriageway.
“On the approach to a take-away premises his car mounted the pavement in an attempt to park.”
The 40-year-old, of 47 Fernhill Road in Glasgow, refused to complete a breath test when asked by police, and was subsequently cautioned and charged.
Davenport’s solicitor, Matthew O’Neill, said his client had been working in Moray at the time.
He said: “Alcohol is not ordinarily a problem for him, but he accepts he consumed it to excess.
“He has held down full-time, well-paid employment throughout his adult life and that speaks well of him.
“He’s extremely ashamed of what happened here.”
Davenport admitted failing to complete a breath test when officers reasonably suspected he had alcohol in his system, and driving without road tax.
He was fined a total of £680 and disqualified for three years.
