A woman called a stroke victim a spastic then threatened to beat him up with his own walking stick.
Rosemary Fitzgerald, known as McCrady, was formerly in a relationship with the man’s partner’s son when she told him she would “kick f*** out of him” with his own walking stick.
Fiscal depute Emma Petersen said the messages were sent to the man, registered as disabled, on November 17 2021 at 7.20am from an address at Watt Avenue in Buckie.
Her relationship with the man’s relative had come to an end four months before.
Called victim a ‘smelly spastic’
The 24-year-old texted the stroke victim telling him: “I suggest you listen closely, spastic.
“Stop telling people I was at Kirsty’s two nights ago and that you got a recording of me cos it’s not me.
“Keep it up and I will kick f*** out of you with your own smelly stick you smelly spastic.”
In a further message, she stated: “And when the time comes and I do get Laura, I won’t be daft enough to ask the s****bag outside, I will get her on a dark night I promise you that.”
The fiscal added: “The complainer replied asking what she was talking about and took a screenshot of the messages. That matter was then reported to the police.”
McCready changed her initial plea and admitted sending grossly offensive and derogatory messages with a disability aggravation.
‘It’s a matter of great regret for her’
Defence agent Stephen Carty said his client’s mental health was impacting her behaviour at the time and that background social work reports had been positive.
“It’s a matter of great regret for her not only that she became involved in this but the manner of the language used,” he said. “She appreciates, in hindsight, that it was totally unacceptable.
“This was somewhat out of character as far as she is concerned and it has caused her enormous concern.”
Sheriff Olga Pasportnikov handed McCready, of Milton Drive, Buckie, a six-month structured deferred sentence to allow her to access mental health support and be of good behaviour.
